Terms and Conditions

WAY – WEEK OF ART YUCATÁN
These Terms and Conditions govern the access and participation of any attendee (“The Participant”) in the activities, visits, exhibitions, conferences, performances, tours, and events organized within the framework of WAY ​​– Week of Art Yucatán (hereinafter “WAY” or “The Organization”). By completing registration, purchasing a ticket, accepting these terms on the platform, and attending any WAY event, the Participant fully accepts the following:

1. Nature of the event and changes without prior notice

WAY is a cultural program distributed across multiple venues, dates, and activities in collaboration with spaces, galleries, private homes, artists, and third parties.

The Organization reserves the right to modify, reschedule, or cancel any activity, venue, host, artist, schedule, or service without liability, including activities listed in the original event program. Changes do not entitle participants to a refund.

2. General Disclaimer

Participants acknowledge that they attend at their own risk and release WAY, its organizers, partners, collaborators, volunteers, host venues, and transportation providers from any liability for:

• Accidents, injuries, physical or emotional harm
• Loss or theft of personal belongings
• Damage to personal property
• Illnesses, discomfort, or reactions to food, beverages, or environmental conditions
• Any incident occurring during transfers, lines, waiting, access to private spaces, or use of transportation coordinated by third parties

This includes activities such as: tours of galleries, studios, private homes, haciendas, performances, lectures, brunches, after-parties, site-specific artwork visits, architectural tours, and other program experiences. Participants waive the right to take any legal action against WAY arising from their participation.

3. Responsibility for Third Parties and Suppliers

Many activities take place in venues not owned by WAY (galleries, private homes, residences, haciendas, hotels, restaurants, transportation agencies such as Catherwood, etc.). WAY is not responsible for:

• Security and infrastructure of these venues
• Transportation provided by third parties
• Internal rules, restrictions, or events within these venues
• Conduct, omissions, or errors of hosts or employees

4. Access and Conduct Rules

Participants agree to:

• Follow instructions from staff, hosts, and guides
• Respect the individual rules of each venue
• Exercise special care in spaces containing works of art
• Refrain from excessive alcohol consumption or risky behavior
• Refrain from entering restricted areas
Failure to comply may result in expulsion without a refund.

5. Activities with Limited Capacity – RSVP

Certain activities have limited capacity as detailed in the original document (e.g., private visits, brunches, tours, VIP activities, etc.).

Confirmation via RSVP does not guarantee access until expressly confirmed by WAY. WAY may deny access without prior notice for reasons of security, capacity, or logistics.

6. Activities with Additional Cost

Participants acknowledge that some events require additional payment (Packages I, II, III, IV, VIP experiences, special visits, meals, or tours). All payments are non-refundable, even if there are changes in the schedule, weather, availability, or host replacements.

7. Transportation

WAY is not responsible for delays, mechanical failures, accidents, or cancellations related to private transportation or transportation provided by third parties.

8. Special Risks and Informed Consent

Some activities require specific conditions, for example:

• Use of a gown or special clothing
• Not suitable for people with epilepsy
• Dietary restrictions
• Access to cenotes, haciendas, or uneven terrain
• Prolonged exposure to sun or heat

Participants accept that it is their responsibility to assess their own health and ability to participate. WAY is not responsible for reactions, injuries, or accidents resulting from these specific conditions.

9. Use of Image

Participants authorize WAY to use their image, voice, or presence captured in photographs or videos during the events, without compensation, for documentation, archiving, dissemination, or cultural promotion purposes.

10. Ticket, Refund, and Transfer Policy

• All tickets, complimentary passes, codes, VIP or general admission access are non-refundable and non-transferable, unless expressly authorized in writing by the organizers.

• Lost or stolen tickets will not be replaced.

• WAY may revoke access in cases of misconduct or breach of these terms.

11. Minors

The events are not designed for minors. Parents or guardians are solely responsible for their safety.

12. Force Majeure

WAY will not be liable for cancellations, delays, or changes resulting from weather events, power outages, blockades, protests, illness of artists, health emergencies, or any cause beyond their control.

13. Acceptance

By completing registration, checking the acceptance box, presenting a ticket, or attending any WAY program activity, the Participant declares having read, understood, and accepted these terms.
